In-Store Terms And Conditions
We cover a lot of information at the time of the sale. Our aim is to help you make the right selection and to ensure you have all the information you need to make your decision.
Our products come with guarantees that cannot be excluded under the consumer laws in Australia. You are entitled to have the item replaced or refunded for a major failure. If there is a minor fault with the product you are entitled to have the product repaired within a reasonable timeframe or have the goods replaced at the discretion of Gallus & Rea.
With each purchase you make it is vital that you read the manufacturer’s warranty card and care instructions and follow them carefully. Your warranty period commences from the date of receipt of your goods.
Your warranty is provided in good faith that you will use and maintain your product as the manufacturer intended. Your warranty will be considered void (subject to Australian Consumer Law) if:
a) the issue is the result of normal wear and tear
b) the product is used in any environment other than domestic residential
c) the product has not been used or maintained in accordance with the manufacturer’s instructions as provided with the product
d) damage is caused by improper cleaning, the product is tampered with in any way or the product in used in an abnormal manner for example if the product is abused, misused, dropped, crushed, impacted with any hard surface, exposed to extreme heat (including fire) or cold, not maintained properly or used after partial failure.
e) the product is not used for the purpose intended eg sitting on the arms of sofas or chairs, or standing or swinging on dining chairs
f) the product is damaged by corrosive materials such as acids or solvents, dyes, inks, paints or human or animal bodily fluids
g) damage occurred during the handling and transportation of the product
h) the product has been modified, incorrectly adjusted or operated, subjected to incorrect electrical supply or inconsistent electrical supply or used with inappropriate accessories
i) repairs to a product are made or attempted by a service provider other than approved by Gallus & Rea
j) the product’s serial number, as applied by the manufacturer, has been altered or removed from the product
The warranty against defect is limited to the original purchaser as specified in the original tax invoice and is not transferable.
To make a warranty claim or a claim under consumer guarantee please contact our team at sales@gallus-rea.com.au. It is generally the responsibility of the
customer to return any product that is deemed faulty to the store if the product is still within the warranty period. Where goods are assessed to have been damaged by misuse or accident, or where your rights under the Australian Consumer Law or any manufacturer’s warranty do not apply, you may be required to pay labour, assessment and/or freight fees.
When placing your order with us, you will be given an estimated delivery date. Gallus & Rea will not be responsible for any unavoidable delays. Occasionally, goods may take more or less time than estimated; every effort will be made to contact you if this occurs. It is expected that you will be in a position to make final payment and accept goods once they arrive.
Full payment for products must be made at the time of purchase, except in the event of made to order products, in which case Gallus & Rea may at its absolute discretion agree to accept a minimum deposit of 50% with the payment of the balance at a later time, but in any event full payment (cleared funds) must be received by Gallus & Rea prior to delivery being arranged or goods being collected.
When your goods are ready for delivery, we will contact you and book a delivery day. Any outstanding monies on your order need to be paid allowing us to receive cleared funds prior to delivery.
In most cases we use a third-party delivery companies who specialises in the delivery of furniture. We have selected companies that care about the product they are delivering and the customers they are delivering to. Specific delivery times on the nominated day cannot be given however, the drivers will call approx. 30 minutes prior to delivery (or up to 1 hour if needed).
Unless specified in writing on your original tax invoice, delivery is based on ground floor delivery and does not include set-up, assembly or removal of any packaging.
We are unable to move, remove and dispose of old furniture. Goods will only be delivered where reasonable access is provided. Extra charges may apply in the event that: the delivery address changes to a more expensive zone; access was difficult; the goods need to be redelivered because of access problems or because there was no-one at the delivery address as arranged to accept delivery; or set up of furniture is requested.
Please be aware that while the delivery team will take all care in your home, Gallus & Rea is not responsible for any damage that may occur. For safety reasons the delivery team are unable to remove their shoes in your home.
We will contact you when your goods are ready to collect. Collection of goods is by appointment only and a minimum of 24 hours must be given. Collection is available only during certain hours which will be advised when we contact you to let you know your goods are ready.
It is important to bring a suitable vehicle for transportation, packaging to protect your goods and two (2) people who are capable of lifting heavy bulky items. Our staff are happy to provide trolleys to assist with your collection however for safety reasons we are unable to assist in lifting and loading.
Gallus & Rea cannot be held responsible for damage that may occur during collection or transit. If you organise a third party to collect the goods, remember they are accepting responsibility for your goods.
Goods must be collected or delivered within 14 days from the date that you are advised they are available, or within an otherwise agreed written timeframe. If you are unable to collect or accept delivery within this timeframe, storage fees will apply and will be calculated at the rate of $20 per week until goods are collected or delivered. Failure to collect or accept delivery will result in the tax invoice being cancelled and all monies paid being forfeited.
An order for products which are made to individual customer specifications including custom size, colour or upholstery, which have to be ordered specifically for a customer cannot be cancelled or returned if the customer has changed their mind or made an incorrect choice. Choices are still considered to be custom even where individual selections are made from the supplier’s range of available sizes, colours and specifications.
Clearance and floorstock products are sold at reduced prices and are not available in conjunction with any other offer or promotion. Floorstock models, seconds, repaired products and products that have a defect where that defect has been drawn to the attention of the customer before the purchase have limited guarantees in accordance with Australian Consumer Law.
The process of allocating or ordering your goods takes place immediately. For this reason we ask that you choose carefully.
Gallus & Rea will not refund simply because you change your mind, find the item does not match or fit within the allocated area, or you find a cheaper item elsewhere.
Gallus & Rea will not accept cancellation without prior written approval from Gallus & Rea Management. Cancellation of an order will attract an administration fee equal to 30% of the total cost of the order. This fee will cover loss of value, administration and inventory costs and other expenses we may incur due to the cancellation of your order.
In the event cancellation of an order is approved (excludes Made to Order), a cancellation fee of 30% of the value of the goods will apply and be deducted from any deposit paid. Orders cannot be cancelled once you have taken delivery or collected the goods.
Many of our products are hand made and may vary in size, weight and colour and minor variations of up to 3% from the sample products in store on product specifications. Gallus & Rea cannot guarantee that upholstered products will match the sample swatch due to dye lot variation.
Timber products are sold with the understanding that each piece is unique with a variation of colour, knots and grain and gum veins. Natural timber and natural stone is beautiful, unique and varied and are sold with the understanding that each piece will have a unique look and variation in colour. Consistency is only achieved in man made products.
It is important that you check the condition of your goods at the time of delivery or collection. Where the goods are packaged and cannot be fully inspected please draw our attention to any damaged packaging immediately. It is important to notify us of any defects that are apparent on first inspection of the goods, such as missing parts or damage as soon as possible and not later than 24 hours following delivery or collection.
For any problems, you agree that Gallus & Rea or its appointed agents may examine and test any goods that are claimed to be defective to establish whether these defects are our responsibility. Where we need to send the goods away for examination or repair, then you will permit us to collect goods for that purpose. Where defective goods are exchanged, you must allow us to collect the defective goods from you. Please also note you may have to wait for replacement goods. Loan goods are not provided.
Most items will require some level of assembly. It is important that you read the assembly instructions carefully as we cannot accept any responsibility for any self-assembly goods that are damaged because instructions were not properly followed.
Gallus & Rea is committed to protecting your privacy. The information you provide to us is collected for the purpose of processing your transaction and keeping you up to date with your order. We may also use this information to deal with your queries or customer service issues. In submitting this information to us, you agree and consent to automatically opting in to Gallus & Rea’s privacy policy. Gallus & Rea will keep you up to date with products, services, events or promotions we think would be of particular interest through email and SMS. If for many reason you wish to be removed from our marketing lists, please unsubscribe or contact sales@gallus-rea.com.au .
It is your responsibility to check your Tax Invoice to ensure that all details are correct. This includes all contact details, including where applicable delivery details, along with model, size, price, quantity, and other special requirements. Our products are sold for domestic use only.
If any part of these terms and conditions is found to be void, invalid or otherwise unenforceable, then that part shall be deemed to be superseded by a valid, enforceable provision that matches the intent of the original provision as closely as possible. The remainder of these terms and conditions shall continue to be enforceable and valid. These terms and conditions will be governed by and construed in accordance with the laws of the State or Territory in Australia where the products are purchased.
Gallus & Rea reserves the right to amend these Terms and Conditions at any time without notice.
